Terms of Service

1. Agreement to Terms

By accessing or using Oxiom's asset tracking platform, devices, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

Oxiom provides:

  • IoT tracking devices (Oxiom Tag, Oxiom Tracker, Oxiom Anchor)
  • Cloud-based asset tracking and monitoring platform
  • Mobile and web applications for device management
  • API access for enterprise integrations
  • Data analytics and predictive insights
  • Technical support based on your service agreement

3. Account Registration and Security

3.1 Account Creation

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You agree to:

  • Use a strong, unique password
  • Notify us immediately of any unauthorized access
  • Be responsible for all activity under your account
  • Not share your account credentials with others

4. Device Ownership and Use

4.1 Device Ownership

Depending on your service agreement, devices may be purchased, leased, or provided as part of a service subscription. Title and ownership rights are specified in your order confirmation.

4.2 Device Use Restrictions

You agree not to:

  • Attempt to open, modify, or reverse-engineer devices
  • Replace batteries (devices are sealed to maintain IP67 rating)
  • Use devices for unlawful purposes
  • Interfere with device functionality or security measures

4.3 Device Recycling

At end-of-life, devices must be returned to Oxiom through our recycling and trade-in program. Instructions will be provided when devices reach end-of-life status.

5. Service Level Agreement (SLA)

Oxiom commits to:

  • Platform uptime: 99.999% availability SLA
  • LTE connectivity: Global coverage across 150+ countries
  • Data retention: Minimum 2+ years, configurable per agreement
  • Support: 24/7 availability (tiered based on service level)

Specific SLA terms and remedies are detailed in your enterprise service agreement.

6. Payment Terms

6.1 Pricing and Billing

Service fees are based on your subscription plan, device quantity, and features. All pricing includes:

  • Hardware devices (where applicable)
  • Global LTE connectivity and roaming
  • Platform access (web and mobile)
  • Data storage (2+ years)
  • Software updates and security patches

6.2 Payment

Payments are due according to your billing schedule. Late payments may result in service suspension. Volume discounts are available for 500+ devices.

6.3 Refunds

Refund policies are specified in your service agreement. Contact sales@oxiom.se for questions about billing or refunds.

7. Data Ownership and Usage

7.1 Your Data

You retain ownership of all data collected by your devices. Oxiom processes this data solely to provide Services as outlined in our Privacy Policy.

7.2 Data Security

All data is encrypted from device to cloud. We maintain enterprise-grade security measures and comply with applicable data protection regulations.

7.3 Data Export

You may export your data at any time via our API or platform interface. Upon service termination, you have 90 days to export your data before deletion.

8. API and Integration Use

If you access our API:

  • You must comply with API documentation and rate limits
  • You are responsible for security of your API keys
  • You may not resell or redistribute API access
  • We may modify API functionality with reasonable notice

9. Intellectual Property

All intellectual property in our Services, including software, hardware designs, documentation, and trademarks, remain the property of Oxiom. You receive a limited license to use our Services as specified in these Terms.

10. Warranty and Disclaimers

10.1 Limited Warranty

Oxiom warrants that:

  • Devices will function as specified for their stated battery life (5+ or 10+ years)
  • Platform will meet the 99.999% uptime SLA
  • Services will perform substantially as described

10.2 Disclaimer

EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OXIOM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

Either party may terminate the service agreement with written notice as specified in your contract. Upon termination:

  • Access to Services will cease
  • You have 90 days to export your data
  • Devices must be returned per recycling program requirements
  • Prorated refunds may apply based on your agreement

13. Governing Law

These Terms are governed by the laws of Sweden. Disputes shall be resolved through arbitration in Stockholm, Sweden, unless otherwise specified in your enterprise agreement.

14. Changes to Terms

We may update these Terms with notice. Material changes will be communicated via email. Continued use of Services after changes constitutes acceptance.
